Childress says team proved case in NASCAR appeal

CHARLOTTE, N.C. (AP) -- Richard Childress is reiterating his frustration in the NASCAR appeals process after an independent panel denied his bid to have Clint Bowyer's penalty overturned.

Childress maintains he proved beyond a reasonable doubt that the car Bowyer drove to victory Sept. 19 at New Hampshire failed inspection because a tow truck damaged the back of the Chevrolet by pushing it to Victory Lane.

The three-member appeals panel ruled the claim was negated by the telemetry from the car, and found that Childress' own expert witness helped NASCAR's case.

Childress has already filed intent to appeal to the chief appellate officer. That is NASCAR's version of the Supreme Court.

In the meantime, Childress says he will focus on ensuring one of his race teams wins the Sprint Cup championship this season.
