Man charged in Upstate murder claims self-defense

ANDERSON, S.C. (AP) -- A judge is deciding whether to accept a claim of self-defense and drop a murder charge against a man accused in a shooting death in the parking lot of an Anderson movie theater.

An attorney for 25-year-old Raphael Parks says the Clemson University engineering graduate was in fear for his life when he grabbed a gun from the glove box of his car and killed 31-year-old Timothy Pickens two years ago.

The Anderson Independent-Mail reports (http://bit.ly/OnVyYe ) that during a hearing Tuesday, several people testified Parks and Pickens were fighting and wrestling when the shooting happened.

Pickens died about eight months after the shooting after performing routine care of the tracheotomy he needed after he was wounded.
