SPARTANBURG, S.C. (AP) -- Sheriff Chuck Wright says the justice system failed a Spartanburg County deputy who was shot and wounded while chasing a suspect.

Wright says 27-year-old Robert Odell Brown should never have been out on the streets given a lengthy criminal history that includes convictions for assault and battery with intent to kill and domestic violence.

Brown is accused of shooting Deputy Brad James twice after a chase late Sunday. Brown was arrested Monday in Virginia and taken to a hospital to be treated for a gunshot wound. Police plan to charge him with attempted murder. It couldn't be immediately determined if Brown has a lawyer.

James was shot near the eye and in the back and is expected to recover.

Wright says the case should lead to changes in the system.
