WACH FOX News has closely been following a case that stems from a February arrest. It involves a 22-year-old Cayce woman accused of smoking marijuana. Her 9-month old son Curtis was placed in DSS care and less than 24-hours later, he died. The woman who was caring for the infant is accused of causing his death.

Angela Dukes was arrested Wednesday night. She remains in jail pending $250,000 bond. SLED investigators say Dukes is a neo-natal nurse who confessed that she taped a pacifier to Curtis' mouth which ultimately killed him.

"This is a heinous thing to do to a child, they can't defend themselves, they can't fight back," says special agent Casey Baccomo.

Curtis was in foster care when he died and he's not the first child to die in that situation. SLED officials say in the last 10 years 18 children have died in foster care. Most of those deaths were ruled accidental but three are considered homicides. The latest tragedy leaves another family wanting answers. Our Ashley Norris exclusively spoke to Curtis' mother Katrina Jivers.

She's outraged about her son's death saying, "How can DSS let someone like that come and work for them."

Initial court documents showed the baby died from heart problems. Jivers says she knew that wasn't right. Wednesday night she learned what investigators believe happened. Angela Dukes wrapped curtis in a blanket, laid him on his stomach and taped a pacifier to his mouth.

"This woman killed him, she murdered him. She knew what she was doing," says Jivers.

According to DSS before Curtis, Dukes cared for three children separately each for a short time and with no complaints reported.

Now, Dukes faces the same charge as Jivers--- unlawful conduct toward a child.

"It's cruel, it's not right. I feel like she should've been charged with murder in the first degree," says Jivers.

Jivers also had to surrender her two-year-old daughter to DSS. The family is doing everything they can to fight this. WACH FOX News will continue to follow the story and keep you updated.
