COLUMBIA S.C. (WACH / AP) -- A federal judge is reconsidering a ruling made in December that struck down key parts South Carolina’s immigration law, which was modeled on similar legislation to that in Arizona.
U.S. District Judge Richard Gergel has scheduled a conference for Monday. He said, in court papers filed last month, it is now likely his original ruling will be revised, given the Supreme Court justices' decision on Arizona’s immigration law.
The Supreme Court, last month, overturned most of Arizona's law but left intact a provision allowing law enforcement to ask the citizenship status of people stopped for another reason. Gergel had blocked that provision in the South Carolina law.
For now, state prosecutors have told South Carolina authorities to abide by the order that put the law's enforcement on hold.
