Question answered about sex offender on the ballot

FAIRFIELD CO (WACH) -- A House of Representatives race took center stage in Tuesday's primary runoff.

The nod for the Democratic nomination in District 41 came down between incumbent Boyd Brown and Fairfield County Councilman Kamau Marcharia, who is a registered sex offender.

Brown won the runoff, but WACH Fox News has still fielded several calls from concerned residents who want to know how a registered sex offender ended up on the ballot.

"Well the state constitution has a prohibition against any person serving or being elected to any office in the state if they have been convicted of a felony unless it's been 15 years since the completion of their sentence, including any parole time until they file for office," explains Chris Whitmire of the South Carolina Election Commission.

So due to the fact Marcharia served his jail time more than 15 years ago, state law allows him to be included on the ballot.
