Court upholds conviction in 91-year-old's rape

COLUMBIA (AP) -- South Carolina's high court says the conviction of a man serving life in prison for raping a 91-year-old woman shouldn't be overturned.

The state Supreme Court ruled Monday that 40-year-old Tommy Hutto got a fair trial and that his attorneys gave him good representation.

Hutto was accused in 1998 of breaking into an Aiken County home, raping the woman and robbing her. He was charged after probation agents noticed cuts on his arms, and DNA samples from the crime scene matched his blood.

Hutto's appellate attorneys had argued that his trial lawyers should have kept the probation agents from testifying about the cuts.

Hutto is serving a life sentence at Lieber Correctional Institution. He is a registered sex offender.
