EHRHARDT, S.C. (AP) -- A South Carolina man has sued a town and its police chief, saying the chief shot him with a Taser in a dispute over equipment he had installed.
Ehrhardt Police Chief James Preacher said Thursday he used a Taser on Scott Mocan after Mocan resisted arrest for breach of peace.
Mocan's lawsuit says he went to the police department Aug. 18 to collect payment for equipment he installed there and at town hall. Mocan says the chief asked to see his driver's license and used the Taser after he refused and tried to leave the room.
Preacher says he didn't ask to see Mocan's license before trying to arrest him. Preacher's attorney has filed a motion asking a judge to dismiss the lawsuit.
Mocan's attorney, Bobby Frederick, would not talk about the lawsuit.
