GREENVILLE, S.C. (AP) -- A prosecutor says an off-duty FBI agent who shot a man outside her South Carolina home will not face charges.
Solicitor Bob Ariail told The Greenville News on Thursday that the agent was acting "as a reasonable person would" to protect herself from immediate danger.
The FBI has identified the agent as Diane D. Saltmarsh, and is conducting its own investigation into whether she followed bureau regulations, policies and procedures.
Saltmarsh shot a man once in the buttocks Nov. 28 after finding him outside her home.
Deputies were called to the agent's home and found 60-year-old Ronnie William Pennington in the driveway.
He has been charged with peeping and aggravated assault and battery.
