CHARLESTON, S.C. (WACH, AP) -- The driver of a van that struck and killed a bicycle rider on a James Island bridge has paid a $113 traffic fine.

An attorney for 44-year-old Gregory Rupley of Charleston says the decision to forfeit bond eliminated the need to report to court Thursday for a hearing on the charge of improper lane usage.

Fifty-four-year-old anesthesiologist Mitchell Hollon was killed July 5 when he was thrown over the wall of the westbound lane to the marsh 40 feet below.

Rupley's attorney, David Aylor, said his client is very saddened by the death of Dr. Hollon and has been cooperative with the investigation into Hollon's death.

"Mr. Rupley has fully cooperated with police and provided his cell phone, computer and any information requested by police officers," Aylor said.

Aylor said the use of cell phone or texting as a cause of the accident was ruled out at the scene.
