COLUMBIA, S.C. (AP) -- An attorney for a South Carolina inmate condemned to die for killing his cellmate says he doesn't plan to appeal even if the state changes its lethal injection drugs.
Appellate defender Robert Dudek says he won't request a stay of execution unless his client asks him to do so.
Jeffrey Motts is scheduled for execution May 6. Authorities say Motts was serving two life sentences for killing his great-aunt and her husband when he killed his cellmate in 2005. He asked that his appeals be dropped.
South Carolina used sodium thiopental in its executions but turned over its supply to federal authorities last week. The state has bought a back-up drug, pentobarbital, but Corrections Department spokesman John Barkley says no decision has been made on what drugs will be used.
