Benji Easler, 6, of Gaffney, died when the train left its tracks at Cleveland Park in Spartanburg. Benji's funeral was being held at Corinth Baptist Church, where his father, Dwight Easler, is pastor.

Spartanburg attorney Tom Killoren says he is filing a lawsuit Wednesday against Spartanburg County, its parks commission and the South Carolina Department of Labor, Licensing and Regulation. Killoren says Brooks Harris, his wife and two children were injured in the crash and are distraught by what happened.

State officials say that the inspector responsible for certifying an Upstate miniature train ride did not complete an inspection of the ride before approving it. The inspector has been fired for falsifying a report on the ride that killed one child and injured several others at a Spartanburg County-owned park Saturday. A vigil for the six-year-old boy will be held Tuesday night
